WARRANTY

TIRE LIMITED WARRANTY/ADJUSTMENT PROGRAM including CASING WARRANTY FOR TRUCK AND BUS RADIAL TIRES

 

The  Yokohama  Rubber  Co.,  Ltd.  ("YOKOHAMA")  provides  this  Tire  Limited Warranty/  Adjustment Program including Casing Warranty for Truck and Bus Radial tires ("Warranty Program") as a policy to warrant  the  tire,   tube and  flap for  replacement  or  adjustment  according  to  certain  recognized conditions.

The existence to manufacturing defect is not a prerequisite to qualify for this Warranty Program which applies to such products used under normal operating conditions indicating adjustable circumstances.

This Policy does not warrant nor express that such products will not deteriorate or that it will not fail or become unserviceable in the absence of proper maintenance.

1. TIRE WARRANTY ELIGIBILITY

This Warranty Program applies to all distributors of YOKOHAMA Passenger Car tires, Light Truck tires,  Truck and Bus tires, Truck and Bus radial casings, Industrial tires and Off-the-Road tires, Tubes and Flaps.

2. DETAILED INFORMATION/DECISIONS FOR PROCEEDING THIS PROGRAM

When the detailed information and/or decisions are required in order to proceed this Warranty Program  successfully,  YOKOHAMA  can  add  and/or  change such  detailed  information  and/or decisions to this Warranty Program as “Condition” at any time.

3. WHAT TIRE IS WARRANTED (AND HOW LONG)

YOKOHAMA Passenger Car tires, Light Truck tires, Truck and Bus tires, Truck and Bus radial casings,  Industrial tires and Off-the-Road tires, Tubes and Flaps which have been manufactured within 60 months, are warranted against unserviceable conditions other than the damage specified on SECTION 4.

Warranty in proportion to remaining usable groove depth:

A. If a YOKOHAMA tire becomes unserviceable under the specified conditions, it will be warranted on a remaining usable groove depth prorated basis.

B. The remaining usable groove depth is calculated by following;

Remaining usable groove depth = Remaining groove depth – 1.6 (mm).

The last 1.6mm (height of tread wear indicator) of groove depth is not considered in remaining usable groove depth.

C. If Truck and Bus radial casing warranty is applicable, tread portion is calculated by remaining usable groove depth and sum of casing portion and tread portion become total warranty.

4. WHAT IS NOT COVERED BY THIS WARRANTY

YOKOHAMA tires are not warranted against any damage due to customer's faults including, but not limited to, the followings:

A. Tires damaged by road hazards (obstacles, debris, etc.) or by fire or accidents. B. Tires damaged due to improper inflation pressure or having been run while flat. C. Tires with premature or irregular wear due to improper inflation pressure.

D. Tires with premature or irregular wear due to the defective mechanical conditions of the vehicle, including misalignment, wheel imbalance, and faulty shock or brakes.

E. Tires in an out-of-round condition after the first 20% of usable groove depth. F. Tires worn out:  1.6mm or less of remaining groove depth.

G. Tires which have been repaired or retreaded more times than the attached condition. H. Tires suffered flat spot while immobile.

YOKOHAMA  Truck  and  Bus  radial  casings  are  not  warranted  against  any damage  due  to customer's faults including, but not limited to, the followings:

A.  Casings which were submitted for claims more than 60 months after the date of manufacture. B.  Tires that do not comply with the regulation complied in the country.

C.  Casings damaged by road hazard injuries or damages caused by obstacles or debris such as cuts, punctures (whether repairable or not), snags, bruises, tears, abrasions, or impact breaks.

D.  Casings damaged by improper mounting/dismounting procedures, improper inflation, or other maintenance abuses.

E.  Casings damaged by continued operation while flat or severely under-inflated.

F.  Casings that cannot be retreaded due to excessive tread wear, regrooving and buffing. G.  Casings damaged by improper application of tire size and/or specification.

H.  Casings damaged by use of aftermarket tire additives, such as fillers, sealants, or balancing substances.

I.    Tires branded by YOKOHAMA to note special classification at time of purchase, such as “NA” (non-adjustable), or tires altered by notching or buffing.

The more detailed information for casing warranty is shown in “Conditions”.

5. EXCLUSION

All obligations or liabilities for loss of time, inconvenience, loss of use of vehicle or other incidental or  consequential damages are hereby excluded. If any notes in distributorship agreement, those items in notes are not exclusion.

6. OBLIGATIONS

A. YOKOHAMA's obligations:

YOKOHAMA will warrant tire under this limited warranty through YOKOHAMA's distributors. B. Distributor's obligations:

a)  Distributor must keep the tire in question to show it to a certified person by YOKOHAMA.

b)  Distributor  must  establish  his  own  warranty  policy  for  his  dealers and/or  customers according to this Policy.

7. ADJUSTMENT BY TREADWEAR PRORATION

A. It must be ensured that the damaged tire is in adjustable condition as provided hereunder. B. A groove depth gauge must be used to take a reading of the groove remaining.

The recommended YOKOHAMA groove depth measuring point on a specific tire should be near the  Tread  Wear Indicator in circumferential grooves and avoiding the chamfer of Tread Wear Indicator.

C. The adjustment credit to distributors shall be calculated as follows:

                                                                             Remaining groove depth (mm)-1.6
Adjustment base price x ---------------------------------------------------------------------------

                                                                              Original groove depth (mm)-1.6

D. If Truck and Bus radial casing warranty is applicable, the adjustment credit to distributors shall

be calculated as follows:

                                                                                 Remaining groove depth (mm)-1.6

Casing Credit + (Adjustment base price – Casing Credit) x---------------------

                                                                                       Original groove depth (mm)-1.6

8. ADJUSTMENT BASE PRICE and CASING CREDIT

Adjustment base price is the price shown in Distributorship Agreement then in effect at the time of adjustment.

Casing credit for this program is the value shown in the “Conditions”.

9. ADJUSTMENT PROCESSING PROCEDURES

If  the  quality  claim  due  to  Manufacturer's  fault  occurs,  the  Distributor  shall  report  the  details through  Supplier or directly to an authorized YOKOHAMA representative immediately and shall keep such  damaged Products until the engineer from YOKOHAMA comes to the Distributor to investigate the cause of damage and collect the necessary products’ information.

If the engineer from YOKOHAMA will not be able to come to the Distributor in reasonable time for inspection of such damaged Products, the claim adjuster of Distributor certified by YOKOHAMA shall   inspect  such  damaged  Products  and  complete  the  claim  application  form  of   "THE APPLICATION FOR DECISION OF DAMAGED TIRE & TUBE" with all blanks appropriately filled up and send it  YOKOHAMA together with photograph(s) of such damaged Products if necessary. The engineer of  YOKOHAMA shall verify all the information of the claim application form filled by certified claim adjuster of the Distributor as soon as he receives it and will inform the Distributor the final result of judgment. The judgment by such engineer shall be final and binding on the parties.

10. TUBE AND FLAP LIMITED WARRANTY

A. If a tube or a flap fails due to defects in materials or workmanship, YOKOHAMA makes an allowance for a new tube or flap. The allowance will be based on the percentage of remaining usable groove depth on the tire that the tube or flap was originally installed to. The tube or flap is warranted only for the original tire's life.

B. The following damages of tube or flap are not covered by this Warranty:

a) Abusive service b) Punctures

C. Distributor's Obligations

Distributor must keep the tube or flap in question to show it to a certified person by YOKOHAMA.
